Though his works survive only in fragments, we know from the writings of Herodotus and Plutarch that his constitutional reforms against the venality, greed and political power-play of Attica's tyrants and noblemen were hugely influential - and may even be said to have laid the foundations of western democracy. La contestation islamique des vingt dernières années remet en cause le fonctionnement actuel des sociétés arabo-musulmanes qui connaissent d'importants problèmes économiques, sociaux, démographiques... Elle révèle la perte de légitimité des modèles et des valeurs, notamment des systèmes juridiques en vigueur. Ainsi le projet politique d'instaurer un ordre islamique légitimé par la Loi coranique (la charia) et par l'exemple des premiers musulmans, se présente-t-il comme une voie possible de recherche de solutions à partir de valeurs authentiques. Mais comment ce projet peut-il s'accommoder des interprétations fort variées de la Loi par le droit, qui ont été produites au cours de l'histoire des sociétés arabes et musulmanes, spécialement depuis la réforme du droit islamique à l'œuvre depuis le siècle dernier ? Quel est le poids, dans ce processus, du droit importé et imposé, des réappropriations de la culture juridique par les États modernes et de la négociation des normes par les individus et les groupes ? En quoi ces mutations obligent-elles à repenser la relation qui s'est instaurée dans ces sociétés entre justice, vérité et histoire ? Telles sont les premières questions posées par ce livre, en partant des expériences collectives de la modernité, et de la réalité des cultures juridiques, dans deux pays arabes du Machreq, l'Egypte et la Syrie, dont les mutations dans ce domaine ont pesé sur les choix faits ailleurs dans le monde arabe et musulman. Bernard Botiveau a accordé une attention particulière au renouveau du savoir et de l'enseignement sur le droit des pays arabes, dans les universités islamiques notamment ; à l'émergence de nouveaux acteurs juridiques, avocats, juges et « justiciables » ; enfin à l'effet des constructions sociales du droit (en particulier dans les statuts personnels) sur une redéfinition de la norme islamique, qui est provoquée autant par les mouvements politiques contestataires que par des gouvernements en mal de légitimité. The fundamental idea of "law and aging" as a discrete category of legal principle and theory is controversial: What special feature and characteristics of "older adults" justify and even require a particular theoretical approach?
